Conditions Générales de Ventes - AC Services (Anti Cafard)
ARTICLE 1 OBJET
Les présentes conditions générales ont pour objet de réagir les droits et obligations de la société AC SERVICES dans le cadre de la vente de produits de Désinsectisation, Dératisation et de Désinfection.
A défaut de contrat conclu entre la société AC SERVICES et l'acheteur, ou de conditions générales ou particulières d'achat expressément acceptées par l'acheteur, les ventes effectuées sont soumises aux conditions générales de ventes décrites ci-après.
En conséquence, tous les produits fournis par la société AC SERVICES impliquent l'adhésion sans réserve du client aux présentes conditions générales de vente, à l'exclusion de tout catalogue, prospectus ou autre document publicitaire qui n'ont qu'une valeur indicative
ARTICLE 2 PAIEMENT ET CONDITIONS DE PAIEMENT
1. Prix
Le prix des produits et services proposés est exprimé en EUROS (€). Les prix sont mentionnés TTC, hors frais de port. Le taux de TVA s'applique au moment de la passation de l'achat.
Tout changement du taux légal de T.V.A. sera automatiquement répercuté sur le prix des produits, à la date stipulée par le décret d'application.
2. Règlement
Le client peut effectuer le règlement de ses commandes soit par carte bancaire soit par chèque. Toutes les cartes françaises sont acceptées ainsi que les cartes American Express, Eurocard, Mastercard et Visa internationales. Les paiements par cartes bancaires s'effectuent via la plateforme PayPal.
Toute commande payée par chèque ne sera traitée qu'à la réception de la somme due.
L'intégralité du prix TTC doit être versée à la commande.
La société AC SERVICES se réserve de suspendre toute gestion de commande et toute livraison en cas de refus d'autorisation de paiement par carte bancaire ou par chèque de la part des organisme officiellement accrédités ou en cas de non-paiement.
ARTICLE 3 RABAIS ET RISTOURNES
Les produits sont facturés aux conditions de tarifs en vigueur au moment de la passation de commande.
Ces tarifs incluent les rabais et les ristournes que la société AC SERVICES serait amenée à consentir.
Des bons de réductions peuvent être utilisés à conditions de leur validité au moment de l'achat. Ses bons de réduction sont fournis par la société AC SERVICES.
ARTICLE 4 CLAUSE DE RÉSERVE DE PROPRIÉTÉ
Les produits vendus comme définis dans le bon de commande ou la facture restent la propriété de la société AC SERVICES jusqu'à paiement intégral du prix par le client.
En cas de redressement ou de liquidation judiciaire du client, la propriété des produits livrés et restés impayés pourra être revendiquée par la société AC SERVICES.
ARTICLE 5 DROIT DE RETRACTATION
AC SERVICES accorde à l'acheteur un délai de rétractation pour les paiements par chèque entre la commande et la réception du chèque. Tout chèque encaissé ne pourra faire l'objet de rétractation.
L'acheteur renonce à son droit de rétraction lors des paiement par carte bleue via la plateforme PayPal. Néanmoins, si la commande n'a pas encore été envoyée, l'acheteur peut revendiquée son droit de rétractation. Si la commande a été envoyée, une preuve de dépôt peut prouvée que le droit rétraction a expiré.
ARTICLE 6 ENGAGEMENT
La société AC SERVICES s'engage à mener à bien la tâche précisée à l'article "OBJET" conformément aux règles de l'art et de la meilleure manière.
ARTICLE 7 FORCE MAJEURE
La société AC SERVICES n'encourt aucune responsabilité en cas de non-exécution ou de retard dans l'exécution de l'une de ses obligations si celui-ci résulte d'un fait indépendant de sa volonté et qui échappe à son contrôle.
Est considéré comme tel, tout évènement extérieur, imprévisible et irrésistible au sens de l'article 1148 du Code Civil.
ARTICLE 8 DROIT APPLICABLE ET JURIDICTION
1. Droit applicable
Les conditions générales, tous les actes et opérations en vertu des présentes ainsi que les droits et obligations des parties aux présentes sont régis et interprétés conformément au droit français.
2. Juridiction
Si les parties ne parviennent pas à régler tout litige relatif aux conditions générales dans les quinze (15) jours suivant la notification écrite adressée par l'une des parties à l'autre concernant ledit litige, ce dernier sera réglé par le tribunal compétent.

Terms and Conditions
ARTICLE 1 OBJECT
These terms are intended to react the rights and obligations of AC SERVICES through the sale of products Pest Control, Deratization and disinfection.
A default contract concluded between the AC SERVICES company and the purchaser, or general or specific purchase expressly accepted by the buyer, sales are subject to the general terms and conditions described below.
Therefore, all products supplied by the company AC SERVICES involve unconditional acceptance of the client to these general conditions of sale, excluding any catalog, brochure or other promotional document are only indicative value
ARTICLE 2 PAYMENT AND PAYMENT CONDITIONS
1. Price
The price of the offered products and services is expressed in Euros (€). The prices are listed including sales tax plus shipping costs. The VAT rate applicable at the time of execution of the purchase.
Any change to the VAT rate will be reflected on the price of products on the date stipulated by the implementing decree.
Rates on our website does not apply in our local store.
2. Regulation
The customer can make payment of its orders either by credit card or by check. All French cards are accepted as well as American Express, Eurocard, MasterCard and Visa International. The credit card payments are made via PayPal platform.
Any order paid by check will be processed upon receipt of the amount due.
The full price including tax is payable to the order.
The company AC SERVICES reserves to suspend any order management and delivery in case of refusal to authorize payment by credit card or check by certified financial institution or in case of non-payment.
ARTICLE 3 DISCOUNTS AND BONUSES
You will be charged with the conditions of the rates in effect at the time of ordering.
These prices include rebates and discounts that the company would have to AC SERVICES consent.
Reductions vouchers can be used for conditions of their validity at the time of purchase. Its coupons are provided by the company AC SERVICES.
ARTICLE 4 CLAUSE OF PROPERTY RESERVE
Products sold as defined in the purchase order or invoice shall remain the property of the company AC SERVICES until full payment by the customer.
In reorganization or liquidation of the customer, ownership of goods delivered and left unpaid may be claimed by the company AC SERVICES.
ARTICLE 5 RIGHT TO RETRACT
AC SERVICES grants the purchaser a cooling-off period for check payments between ordering and receipt of the check. All checks cashed will be subject to withdrawal.
The buyer waives his right of withdrawal when paying by credit card through the PayPal platform. However, if the order has not yet been sent, the buyer can claimed his right of withdrawal. If the command was sent, a deposition proven that the evidence may shrink law expired.
ARTICLE 6 COMMITMENT
The company AC SERVICES is committed to carrying out the task specified in section "OBJECT" according to the rules of art and in the best way.
ARTICLE 7 FORCE MAJEURE
The AC SERVICES company is not liable for non-performance or delay in performance of any of its obligations if it results from an act beyond its control and beyond its control.
Considered as such, any outdoor event, unforeseeable and irresistible within the meaning of Article 1148 of the Civil Code.
ARTICLE 8 APPLICABLE LAW AND JURISDICTION
1. Applicable law
The general terms, all acts and transactions hereunder and the rights and obligations of the parties hereto shall be governed by and construed in accordance with French law.
2. Court
If the parties fail to settle any dispute relating to the general conditions within fifteen (15) days written notice by either party to the other concerning that dispute, the latter shall be settled by the competent court.
